FilingHub operates as a Data Fiduciary under the Digital Personal Data Protection Act, 2023 ("DPDP Act") and is committed to protecting the personal data of every Data Principal (user, client, visitor) who interacts with our platform.

This Privacy Policy governs all personal data collected, processed, stored, transferred, or otherwise handled by FilingHub in connection with:

• Your registration or account creation on our platform;

• Your engagement with us for any service (consultancy, filing, compliance, registration, etc.);

• Payment transactions carried out on or through our platform.

• Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules) — prescribes standards for collection and handling of sensitive personal data;

• Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (IT Rules 2021) — imposes obligations on online platforms regarding user data and grievance redressal;

• Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020 — protect consumer rights in online transactions;

• Indian Contract Act, 1872 — governs the validity and enforceability of digital agreements and consent;

• Reserve Bank of India (RBI) Guidelines on Payment Aggregators and Payment Gateways — applicable to payment data processing;

• Goods and Services Tax Act, 2017 — to the extent data is processed for GST compliance purposes;

• Income-tax Act, 1961 — to the extent data is processed for litigation purposes under the Act;

• Income-tax Act, 2025 — to the extent data is processed for tax filing purposes;

• Companies Act, 2013 — to the extent data relates to MCA and ROC filings;

• Telecom Commercial Communications Customer Preference Regulations, 2018 (TRAI) — governs commercial communication via SMS and voice.

Terms used in this Policy carry the meanings assigned below, consistent with the DPDP Act, 2023.

We collect only such personal data as is necessary and proportionate to the purpose for which it is collected.

• Full legal name, date of birth, gender;

• Residential and business address;

• Email address and mobile/telephone number;

• Photograph (where required for regulatory purposes).

• Permanent Account Number (PAN);

• Aadhaar (collected only where legally required and with explicit consent);

• GST Identification Number (GSTIN);

• Corporate Identification Number (CIN), Director Identification Number (DIN);

• Import Export Code (IEC), FSSAI License Number;

• Passport, Voter ID, Driving Licence (as applicable for specific services).

• Bank account details (account number, IFSC code) / CANCEL CHEQUE.

• Payment instrument details processed through secure third-party payment gateways (not stored by FilingHub);

• Income details, TDS certificates, Form 16, balance sheets, profit and loss statements;

• GST returns, tax challans, and related financial documents;

• Invoice and transaction records related to services rendered.

• Company or LLP name, registered address, nature of business;

• Director/partner details and shareholding information;

• Memorandum and Articles of Association, partnership deeds;

• Licenses, registrations, and statutory certificates.

• IP address, browser type and version, operating system;

• Pages visited, time spent, clickstream data;

• Cookies and tracking technologies (see Section 10);

• Device identifiers and geolocation data (where enabled by the user).

• Records of correspondence via email, WhatsApp, telephone, or chat;

• Feedback, queries, complaints, and survey responses;

• Call recordings (where legally permissible and with prior notice).

FilingHub processes your personal data only for specified, legitimate purposes. We rely on one or more of the following legal bases under the DPDP Act, 2023.

• Compliance with a judgment, order, or decree of a court or tribunal;

• Response to a medical emergency threatening life;

• Employment-related processing covered under applicable labour law;

• Processing to provide benefits or services to Data Principals by the State.

• Creating and managing your FilingHub account and service profile;

• Providing contracted services — GST filing, income tax returns, MCA compliance, business registrations, accounting, etc.;

• Processing payments and issuing invoices, receipts, and refunds;

• Filing returns, applications, and communications with statutory authorities (Income Tax Department, GST Network, MCA Portal, FSSAI, MSME, etc.) on your behalf and with your authorisation;

• Complying with mandatory reporting obligations under Indian tax, corporate, and financial laws;

• Communicating service updates, document requests, filing reminders, and deadlines;

• Sending marketing communications and newsletters (with opt-in consent only);

• Investigating complaints, handling disputes, and legal proceedings;

• Improving our website, services, and user experience through analytics;

• Fraud prevention, identity verification, and information security;

• Maintaining statutory records and audit trails as required by applicable law.

We do not sell your personal data. We share it only as necessary and as described below.

• Cloud hosting and infrastructure providers (e.g., AWS, Google Cloud, Azure);

• Payment gateway providers (e.g., Razorpay, Paytm, CCAvenue) — payment card data is processed directly by them and not stored by FilingHub;

• Communication service providers for SMS, email, and WhatsApp notifications;

• Accounting and document management software vendors;

• Legal and compliance software platforms.

We retain your personal data only for as long as necessary for the purposes stated in this Policy and as required by applicable law. If you has not availed our services for continuous period of more than 6 months that data will be deleted and the below mentioned period will not prevail

Upon expiry of the applicable retention period, personal data is securely erased, anonymised, or destroyed in a manner that prevents reconstruction.

Under the DPDP Act, 2023, you have the following rights, which we are obligated to honour subject to applicable conditions.

FilingHub does not knowingly collect, process, or store personal data of children (individuals below the age of 18 years) without verifiable parental or guardian consent, as required under Section 9 of the DPDP Act, 2023.

Our services are primarily designed for adult individuals and business entities. If we become aware that we have inadvertently collected personal data of a minor without verifiable parental consent, we will promptly delete such data and, where applicable, deactivate the associated account.

FilingHub does not engage in behavioural monitoring or targeted advertising directed at children.

Notwithstanding the foregoing, no system of data transmission or storage can be guaranteed to be 100% secure. FilingHub does not accept liability for breaches attributable to events beyond its reasonable control.

Our website may contain hyperlinks to third-party websites, tools, or resources. This Privacy Policy does not apply to such third-party websites. FilingHub is not responsible for the privacy practices, content, or security of any external sites. We encourage you to read the privacy policies of any third-party website you visit.

In accordance with the DPDP Act, 2023, the IT Act, 2000, and the IT Rules 2021, FilingHub has appointed a Grievance Officer for data protection matters.

For any data protection concerns — including requests to access, correct, erase, or port your personal data, or to withdraw consent — please contact the Grievance Officer using the details above.

If your grievance is not resolved to your satisfaction within 30 days, you may approach the Data Protection Board of India upon its constitution under the DPDP Act.

FilingHub reserves the right to update or modify this Privacy Policy at any time to reflect changes in law, regulatory guidance, business operations, or technology. Amended versions will be published on our website with a revised "Effective Date". Where changes are material, we will provide prominent notice on our website and, where required by law, seek fresh consent.

This Privacy Policy is governed by and construed in accordance with the laws of the Republic of India. Any dispute arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India.
